ADA Title II / Section 504 Grievance Procedure

Alexandria International Airport

Purpose

The airport has adopted this grievance procedure to provide for the prompt and equitable resolution of complaints alleging discrimination on the basis of disability in the airport’s programs, services, or activities, in accordance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act.

Filing a Complaint

Any individual who believes they have been subjected to discrimination on the basis of disability may file a complaint. Complaints may be submitted by the individual or an authorized representative and should be filed as soon as practicable after the alleged incident.

Complaints may be submitted in writing or submitted online to include the following:

  • The complainant’s name and contact information
  • A description of the alleged discriminatory action
  • The date and location of the incident

ADA Coordinator

The airport has designated an ADA Coordinator responsible for receiving and coordinating the review of complaints.

Review and Response

Upon receiving a complaint, the ADA Coordinator will conduct an appropriate review. When feasible, the airport will provide a response outlining the results of the review and any actions deemed appropriate, consistent with applicable regulatory requirements and operational considerations.

Appeal

If the complainant is dissatisfied with the determination, a written appeal may be submitted to the Executive Director within fifteen (15) calendar days of receipt of the written decision.

The Executive Director, or a designee not previously involved in the investigation, shall review the grievance, the initial determination, any additional information submitted by the complainant, and any relevant information obtained during the review.

The Executive Director shall issue a written decision on the appeal within thirty (30) calendar days of receipt of the appeal. If additional time is required due to the complexity of the matter or the need for additional information, the complainant will be notified in writing of the reason for the delay and the anticipated date of the final decision.

The Executive Director's decision shall constitute the Airport's final administrative determination. Nothing in this procedure limits the complainant's right to file a complaint with the U.S. Department of Justice, the U.S. Department of Transportation, the Federal Aviation Administration, or pursue any other remedies available under applicable federal or state law.

Requests for Reasonable Modification or Accommodation

Alexandria International Airport (AEX) is committed to providing individuals with disabilities an equal opportunity to participate in and benefit from its services, programs, and activities.

Individuals may request a reasonable modification to Airport policies, practices, or procedures, or request an auxiliary aid, service, or other accommodation necessary to access Airport services, programs, or activities.

Requests should be directed to the Airport ADA Coordinator and may be submitted in person, by telephone, by email, or in writing. Requests should be made as far in advance as practicable; however, requests made during an emergency or at the time services are needed will be considered whenever reasonably possible.

Upon receipt of a request, the Airport will engage in an interactive process with the requester, when appropriate, to determine the nature of the requested accommodation and identify an effective reasonable modification.

The Airport will provide a written response within fifteen (15) business days of receiving a complete request. If additional time is required, the requester will be notified of the reason for the delay and the anticipated response date.

A request may be denied only if the requested modification would:

  • Fundamentally alter the nature of the Airport's service, program, or activity;
  • Create an undue financial or administrative burden; or
  • Pose a direct threat to the health or safety of others that cannot be mitigated.

If a request is denied, the Airport will provide a written explanation of the reasons for the denial and information regarding the Airport's ADA grievance procedure.

Accessibility

This grievance procedure will be made available in accessible formats upon request.
